Hunting is illegal within the city limits

Every year around this time, when the hunting season for small game and migratory birds opens, the calls start coming in to the Timmins police.

Landowners in areas such as Kraft Creek Road, Shirley Street North, Jaguar Drive and Sandy Falls Road report hunting is too close to be comfortable in their areas.

TPS Communications Coordinator Marc Depatie:

“These areas are considered rural, but they are residential in nature and there are also industrial facilities in these areas.”

In these cases, a municipal by-law overlaps with Criminal Code provisions aimed at this illegal activity. Depatie recommends that you hunt further into the bush. The “I didn’t know” excuse doesn’t work.

“The onus of knowing where you are and whether or not it is legal to engage in small game hunting or migratory bird hunting in a particular area rests squarely on the shoulders of the individual sportsman.”

This is an obvious matter of public safety. Here is the city by-law prohibiting the use of firearms within the city limits.

CITY OF TIMMINS BY-LAW NO. 1991-3778

BEING A BY-LAW OF The Corporation of the City of Timmins to regulate and prohibit the discharge of firearms.

WHEREAS under section 210, subsection 29 of the Municipalities Act, RSO 1980, chapter 302, as amended, by-laws may be passed by the councils of local municipalities to regulate and prohibit the dumping of firearms in the municipality or in any defined area or areas thereof;

AND WHEREAS it is deemed appropriate to enact a by-law for these purposes;

THEREFORE, Council of the Corporation of the City of Timmins enacts the following:

  1. That City of Timmins By-law No. 898, No. 2016 and Mountjoy Improvement District By-law No. 80 and Township of Tisdale By-law No. 1241 and City of Timmins and the Township of Whitney -Bill 434 is repealed.
  2. Definitions in this regulation:

(1) “Firearms” means a rifle or any other type of weapon, including airguns, spring-loaded guns, crossbows, longbows, or any class or type thereof.

  1. No person shall discharge a firearm in any of the following defined areas located within the City of Timmins.

(1) All part of lots 1 to 5 included in the N1⁄2 of the 3rd. Concession to the 6th. Concession in the

geographic area of ​​Cody Township;

(2) All this part of lots 1 to 12 included in the 4th. on the 6th. Concessions in the geographic area of ​​the Township of Deloro;

(3) This part of lots 7, 8 and 9 on the 4th. Concession, lots 8 and 9 on the 5th. Concession in the geographical area of ​​Evelyn Township which is located less than ONE HUNDRED AND TWENTY (120) METERS from the shore of Ice Chest Lake;

(4) All this part of SW1⁄4 of S1⁄2 of lot 8 in the 5th. Concession, NW1⁄4 of N1⁄2 of lot 8 to 4th. Concession, SE1⁄4 of S1⁄2 of lot 9 to 5th. Concession, NE1⁄4 of N1⁄2 of lot 9 of 4e Concession, lot 8 to lot 12 included in 6th. Concession in the geographical sector of the Canton of German;

(5) This part of the N1⁄2 of lots 6 and 7 in the 5th. Concession and the S1⁄2 of lots 6 and 7 of 6e Concession, in the geographic area of ​​the Township of German which is located less than ONE HUNDRED AND TWENTY (120) METERS from the shore of Barbers Bay;

(6) This part of S1⁄2 of lot 8 of the 4th. Concession and the N1⁄2 of lot 8 on the 3rd. Concession, in the geographic sector of the Township of German which is located less than ONE HUNDRED AND TWENTY (120) METERS from the shore of Lac Charland;

(7) All this part of lots 1 to 5 included in the 1st. on the 4th. Concessions, lots 6 to 8 included on the 1st. and 2nd. Concession and the S1⁄2 of lots 1 to 3 included on the 5th. Concession in the geographic area of ​​the Township of Hoyle;

  1. Exemptions

(1) That the Council of the Corporation of the City of Timmins, may, upon request, issue a permit for the unloading of firearms, in the defined areas described in Section 3, as required at a military funeral or at a trap shooting tournament or a sporting event, any sporting or aquatic competition, or to allow any club to organize shooting events in premises occupied for this purpose.

  1. Penalties

(1) Any person who violates the provisions of this by-law is guilty of an offense and liable, on conviction, to a fine not exceeding $5,000.00, exclusive of costs, as authorized by law Provincial Offenses, Section 62, RSO 1980, Chapter 400, as amended.
